Due to the public health emergency and the declaration of local disaster, the Visitation and Access Orientation had been postponed until further notice. We are currently exploring an online/streaming solutions for future dates regarding orientation.
Currently, the biggest question we receive from parents is whether or not the stay in place mandates impact possession and access schedules. The short answer is NO, there is no impact on unsupervised possession and access orders, but please seek the advice of private counsel for further explanation or issues that may impact your particular case. The Supreme Court of Texas in the SEVENTH EMERGENCY ORDER REGARDING THE COVID-19 STATE OF DISASTER states in part:
For purposes of determining a person’s right to possession of and access to a child under a court-ordered possession schedule, the existing trial court order shall control in all instances. Possession of and access to a child shall not be affected by any shelter-in place order or other order restricting movement issued by a governmental entity that arises from an epidemic or pandemic, including what is commonly referred to as the COVID-19 pandemic. Additionally, Tarrant County has suspended the Supervised Possession and Access sessions held at the Tarrant County Family Courts Building until further notice. If your access or exchanges occur at the family courthouse, please check with Family Court Services for any updates on when the program will resume.
