Effective October 1, 2003 only persons who have received an Authorization from the Tax Assessor Collector’s Office will be allowed to purchase Real Property at the Tarrant County Constables Sale on the first Tuesday of each Month.
Section 34.0445 (a) Civil Practice and Remedies Code has been added as follows:
An officer conducting a sale of real property under this subchapter may not execute or deliver a deed to the purchaser of the property unless the purchaser exhibits to the officer an unexpired written statement issued to the person in the manner prescribed by Section 34.015, Tax Code...
In addition 34.0445 (b) Civil Practice and Remedies Code reads as:
An individual may not bid on or purchase the property in the name of any other individual. An officer conducting a sale under this subchapter may not execute a deed in the name of or deliver a deed to any person other than the person who was the successful bidder.
34.0445 (e) Civil Practice and Remedies Code reads as:
A person who knowingly violates this section commits an offense. An offense under this subsection is a Class B Misdemeanor...
Persons who purchase Real Property on or after October 1, 2003, will be required to furnish the Officers conducting the sale a copy of the written authorization from the Tarrant County Tax Assessor Collectors Office prior to a constables Deed being issued.
To obtain this authorization you must go to the Tarrant County Tax Assessor Collectors Office 100 E Weatherford St. Fort Worth, Texas, Tarrant County Administration Building, first floor. There will be a cost of $10.00 to cover the cost of issuing the Statement. For Information about this process Contact the Tax Assessor Collectors Office at 817-884-1186.
The amount of time required to obtain the statement will be approximately two (2) weeks, from request to issuance.
